Need Some Help

He said because I had comprehensive coverage it wouldn't raise my premiums, but the down side is that the best price I've found for a new wheel assy. is $879 and my deductible is $500 so it's kind of a wash. The advantage to buying and installing a new wheel and then suing the owner is that I'll be able to restore my Rocket to 100% condition right away instead of switching into Rage Mode every time I see it in it's present condition. Your advice regarding filing complaints with other entities is another course of action I may pursue as well...Thanks.
 
PK; There are some wheel repair shops that restore rims for Bentley, Ferrari, Porsche, Lamborghini you name it. Rash, bends, cracks, anything. Save your rage energy for a true enemy. I just bought a used rear rim to install a car tire. Going to buy the front and go to a local shop and get creative with them. It's just metal and money. Peace brother, don't let a rim take that away from you. :) Get a quote and ask the shop for the $. If they refuse, fix it and then go to small claims.
 
A couple of questions come to mind regarding this whole situation. The dealership owner repeated that his "best" technician performed the service on my R3R. I find it hard to believe that an experienced tech wasn't aware that damage had occurred when he mounted the tire to the rim. So it's my opinion that one of two things took place here. Either the tech was fully aware of what happened and chose to not bring it to the attention of his superiors, or he DID advise the owner or service manager of the situation and they elected to keep quiet about it. Either way...someone opted to send me down the road without mentioning what had happened to my property. (I guess hoping I wouldn't discover it right away, or maybe that I had somehow damaged it myself). Clearly honesty and integrity are nonexistent at this dealership, and if that's true, should I also wonder about how much attention was paid to my 10,000 mile service? Did they skip over inspecting items on their check list? I shouldn't have to wonder about such things when I take my property to an Authorized Triumph Dealer. We all work hard for our money, and dealers don't waste any time attaching a price to their services or parts. At the very least we should be able expect a fair return for our hard earned dollars...But hey...that's just my opinion.

The primary reason that I suggested filing a claim with your insurer, PEKAY, is for the added nuisance value against the dealer. Since it seems to be an easy case to make that the dealer's shoddy work was the proximate cause of your damages and if insurance regs in TX are similar to how it is here in NJ, your insurer will subrogate the claim, i.e, they will go after the dealer's insurance carrier for 100% reimbursement of their loss exposure and also for your out of pocket expense, aka, your deductible. If they are successful with the subrogation you not only will have saved $379, but your $500 deductible should be fully reimbursed based on the dealer being at fault.

As for taking this through the judicial process, of course, I was inferring doing so via small claims court. Your total damages do not rise to the level necessitating or justifying a full-blown lawsuit, so the $10,000 threshold for remedy via small claims in TX is more than sufficient.

Speaking of dealers, how's about nominating them for The Hall of Shame by naming them here? That way, others in your area will not voluntarily become victimized by the same shoddy workmanship, dishonesty and lousy customer service that this dealer has inflicted upon you.

And 1K9, yes I agree, as much as we would all like to know who this Turkey is, I would hold fire on naming him until after any litigation has been completed.
Then, I wouldn't hesitate to put his name out there !
 
Absolute bummer. You have my sympathies and I hope it gets sorted soon to your satisfaction
