The use of a hammer to assault results in the use of a gun, IMO!
That little puke was threatening with the hammer by just presenting and holding it at the ready.
I would have presented him Roscoe at the point he first displayed the hammer.

All true, but we don't really know what happened before. Sometimes it's the driver that gets upset and hits the bike out of anger. If so, the driver escalated the situation to the threat of deadly force. We really don't know the whole story.

Even if the cage driver had purposely struck the motor, it was NOT an attack against the person of the rider. Hell, the cage driver had empty hands!
Although he did feign a furtive movement toward the motor rider, he was not within hand or foot range and he definitely did NOT present any serious life threatening threat to the motor rider who had seriously escalated the incident by bringing a hammer to a verbal argument.
The cage driver was STUPID indeed to offer a challenge, to what he apparently thought was a ridiculous hammer threat, by bending over.
That motor rider " be all hat and no cattle" thinking a hammer was necessary.
I believe that legally speaking, a man presenting a hammer in a threatening manner to another could be shot, same as if it was a knife.
