Tranny problem again part duex

I just got contacted by L&D about the bike. They had called Triumph and told me that Triumph will pay for parts but not labor. It is approx 8 hrs labor to pull engine and work on tranny,I was also told that 5th gear was not part of the so called upgrade kit and that they had done a partial upgrade to my bike when it was in for the 2nd/ 3rd gaer problem last Sept.
My question is what is a partial upgrade and why did they not do the whole upgrade, I also had to replace the ignition switch about 2 weeks after I got it back last Sept and it looks like from what I saw of the upgrade list, that was one of the items to repair. I had to pay for switch and labor for that.
Does anyone have the complete list of what is actually in the upgrade kit,
Not to sound like a wimp, but I have been unemployed since Jan 09 was a contractor for the US Gov So I cant collect unemployment and no it was not a high dollar contractor just me loading airplanes and getting hourly wages but no taxes or unemployment taken out, hence not eligable for unemployment.I have a 17 year old Sr at home and I am a single parent with not support coming in ...long story...
So anyone with an Idea on how to talk triumph into making good on the fix etc
ps the Rock is my main transportation seeings the Son has to drive my old truck to school.
Ok sorry to go off like that but I had to vent I am just looking to do things the right way and hopefully the least expensive way. Any and all suggestions would be appreciated

I am trying to come up with a full list also so I can see what parts I already have on the shelf. Mine is jumping out of second gear so I just don't use second and go right to third. I am making arangements to have Triumph verify the problem and if they can Triumph Corp. said they would cover it. If I find out what it has in the kit I will let you know as the part number for the kit shows nothing in the computer.
