2nd gear coming out issue

Ever since I have had this rocket III it has had the following issue. It can sometimes pop into neutral from 2nd gear only when I'm giving her the beans, if I make sure I pulled back as hard as I should when shifting with my foot it usually did not happen. I suspect that its damage from when it was dropped? Otherwise all gears and everything works great. Usually it is a little picky about revving it up to down shift into 1st otherwise it drops into neutral.

The new issue now is that it under load will drop out of 2nd when i ride 2 up and it keeps coming out if I had downshifted into it. But upshifting has the same results as before (only happens if i go WOT at high revs if i dont hold back the shifter).

I dont think it's the detent spring, i have the clutch cable and arm adjusted correctly, and when I had the cover off the clutch actuator pin was in great shape.

What's going on? Any suggestions?
It's difficult and or dangerous to ride like that. Wife and i did 2 up in the canyons here in deer creek over to foxton and it became sketchy as I use 2nd quite often in back roads and switchbacks.

Also I have always had a hickuo or 2 in 2nd around higher revs but again when I was giving it the beans.

Progress to now that I have the new pipes and deCAT nothing changed. Then I put the ramair intake on and did a 12 minute tune as per instructions. I also removed the secondary butterflys. Now the hickup issue happens a lot maybe 5 to 10 times during all rpm range in the entire duration of a full lull in 2nd gear and is not dependent on load or throttle, it can and does happen at just cruising to next to idle revs. When I say hickup I mean a misfire. Never in any other gear.
I changes to overhead coils and new plugs ngk 7ae-9 gapped correctly. Old plugs were also fine btw, but it did not change that issue but did smooth out how the engine ran maybe!
I am still on the origional tune and I suspect that once I flash in a proper tune that hickup issue will go away?

The old second gear problemo...long story short it's engine out & split to fix gearbox issue...very common on early rockets, it happened to an 06 of mine. Unless you can do it yourself it's probably cheaper to sorce another engine.

Ok, so what is the exact issue I would then need to fix?
I saw a engine with 20k mileage for $1500! I could have the engine out and fixed for? I am more than able to have 3 complete torn down motorcycle projects all at once in a 1 car garage!

They actually made an upgrade kit to fix this problem but are very hard to find now. Something to do with the gear selector fork & second dog gear etc...others will give you a better run down on exact issue.
 
The second gear jumping out issue will be nothing to do with ecu...

Maybe i should edit this thread to reflect only ONE of the 2 issues i have with 2nd gear. ... thats what im going to do. Ill start a new thread about the issue i have separate from the 2nd gear popping out int neutral.
BTW the issue i have is a fuel/ignition issue that the engine has a missfire, it only happens in 2nd gear.

Probably mucking up the gear position sensor that goes to ecu because of second gear issue 🤔

btw, i it does not come out of 2nd very often, it only got a bit crazy when i was going 2 up and giving it the beans. right now i can control it good enough to not worry about it, but these hiccups missfires make it impossible to ride with any confidence.
