Very curious what the negligent part of the charge hinges on in this case vs vehicular manslaughter.

Intuition tell me a phone is involved.

I think the negligence is standard. Has to be negligence to have liability. (Speaking from insurance perspective) but I would think it's pretty close
 
I have to assume they found some indication of drug use and got a warrant.
 
It's not necessary for the warrant to specify drugs if they were in plain view as long as the warrant was lawful and served properly any illegal materials incidentally collected are admissable.

Plain View Doctrine - a good reason to NEVER let a cop in your house while on dutywithout a warrant.
