Hello from NY,
I would appreciate opinions. Brought my 2010 R3R to a local shop to have PCV w/auto tune and Gpro with ATRE installed and dyno'd. Got my bike back with valve cover leak (you can see gasket not in place). Oil is leaking bad from valve cover and heavy smoke/blow-by from crank case vent. Shop owner says not his fault and the problem is from not big enough crank vent. I am using same crank vent that Carpenter Racing uses for their 240 HP engines. Plus, he did not install the auto tune and by-passed the oxygen sensor, but charged me for it anyway. He didn't tell me that he did not install Autotune. Realized it when I got home and was checking the oil leak. To make matters worse, he charged me $1280. I think the engine is blown, sounds more like piston/ring problem more than vent problem.
I would appreciate any advice on this matter.

Do you think I can take him to court? He wants to take my bike back, but I don't trust him. Would rather bring it to a reputable shop, such as Carpenter Race.
 
You'd probably find it easier if he just fixes it so I'd be tempted to give it back to him with a "fix it or else". Alternatively take it somewhere else for a complete going over and diagnosis but as they won't have seen the bike before it went to the other shop I'm not sure how that's going to help at this point - and it could end up costing you a lot of $. First guy should fix it for free so give him a shot at it first. Were the dyno numbers OK? That should indicate how it was running at one point.

Gary, I do not want to upset you but did the shop do any other work. I am only asking as you do not have to pull the valve cover to install PCV or the auto tune if he would have installed it also.

compression blow by in a cylinder could push oil out the vent filter but most of us who have lost a head gasket noticed an oil leak on the back of the engine where the crank vent hose goes into the block. It would seep out the back of the head and soak the whole back of the engine. This could be a possibility which would be warranty most likely Are you running triple filters or the standard one under the seat?
I never under stood the Gig pro stuff or whether it was worth the trouble when you could just change timing in the ecu. Except for the gear indicator which the Roadster has anyway. Did they tune the bike in each gear or just use the PCV like a PC3? did the dyno the bike also?

on the plus side if you send it to Carpenter Racing you will get back a animal with twice the hp :D

Do you think they could have dyno'd it and over reved it during the process?
This could have caused semi seizure or piston ring hitting a cylinder top ridge breaking one or more rings maybe.
The blow bye would increase the crankcase pressure to the degree that the pressure just blew the cover gasket and pushed oil out.

I know its no comfort to you but it sounds like someone has stuffed up big time and stopped any further work just wanting to get the bike away from their premises maybe hoping to blame the owner for something... Bastards!

I would find some of ya big mates and go back..dont know nif I would let them try to fix it though, they may cover up some other problem..
Do you have the dyno slip?
It might tell a story if they gave you a true copy.

Sorry to here this mate.. bloody heartbreaking I would think...

You go back and after bashing the bastards head on the wall and floor a couple of times, be sure to explain when you get pissed off you're gonna actually break every bone in his head. Offer him a aspirin, and ask how he is gonna fix your R3 at his expense.
 
I think that if you have it repaired at another dealer then you would lose all claim against this lousy bas****d that f****d up. By all means have it diagnosed elsewhere but I would not have them fix it unless the aforesaid bas*****d gives permission & agrees to foot the bill. And the very best of luck with that.
