    Had the same thing happen to me, I found it would stay in gear if I kept the lever depressed when changing gears... Turned out to be a broken $10 spring that sits on the end of the shifter (detent) shaft located behind the clutch, was found in 2 pieces sitting on the bottom of the clutch housing...

    Got myself a new 08 "cupcake" back in April this year and put 6500km on it over our winter period, great bike for what I want it for... Thought it bout time I joined in... Interesting forum:)
